SHOW/BREEDING QUALITY SALES CONTRACT

North Bay Akitas/Anthony & April Harris (Seller) and __________________(Purchaser)

Agree to the following sales contract:

SELLER AGREES TO THE FOLLOWING:

1.  Guarantee that below described dog is in good health with all necessary vaccinations for its age (see attached schedule of vaccinations given) for up to 72 hours after the time of purchase.  If said dog is found to be ill attributable to Seller within 72 hours, as diagnosed by two veterinarians, one being of Seller’s choice, said dog may be returned for replacement with a dog of similar age and quality at the Seller’s discretion.  If no such dog is available for replacement, Seller agrees to replace said dog with one of equal value from the first available litter or refund Purchaser’s full purchase price of said dog.

2.  Guarantee said dog to be free of hip dysphasia up to 25 months of age, as determined by the Orthopedic Foundation For Animals, Inc.’s qualification for passing (worse than “fair”).  Should there be an assumption other than by OFA of hip dysphasia, hip x-ray must be read by a certified radiologist and the reading results must be submitted in writing by the certified radiologist to Seller.  If found worse than “fair”, Seller agrees to replace said dog with one of equal value from the first available litter at Seller’s discretion after receipt of written proof of spay/neuter of said dog.  Final hip x-rays for OFA must be done no later than 30 days after two-year birthday to be guaranteed by this sales contract.

3.  Guarantee said dog to pass eye certification for Progressive Retinal Atrophy (PRA) up to 24 months of age, as determined by a certified ophthalmologist.

4.  Guarantee said dog has no disqualifying faults as stated in the present AKC approved Akita Standard up to 24 months of age.  These faults being of a hereditary and not of an environmental nature only.  These disqualifying faults are as follows:  (a) drop or broken ears; (b) noticeably undershot or overshot bite; (c) bitches under 23” at withers and dogs under 25” at withers; (d) sickle or uncurled tail; or (e) butterfly nose or total lack of pigmentation on nose.  If through no fault of the Purchaser said dog is found having one of these faults as determined by Seller, Seller agrees to replace said dog with one of equal value from the first available litter at Seller’s discretion after receipt of written proof of spay/neuter of said dog.

5.  Seller shall provide Purchaser with any advice or assistance pertinent to care, feeding, grooming, training, showing, breeding, etc., of said dog upon request of purchaser.

PURCHASER AGREES TO THE FOLLOWING:

1.  Take said dog to a licensed veterinarian within 72 hours from time of purchase for a health examination.

2.  Have said dog’s hips X-rayed for dysphasia at the age of 24 months or prior to breeding.

3.  Have said dog’s eyes examined for PRA by a certified ophthalmologist prior to breeding.

4.  Maintain said dog in a healthy environment at all times, i.e., adequate food, exercise, kenneling, medical care, and proper living conditions to achieve full genetic potential, as defined by normal moral values.  Purchaser agrees to keep said dog in their home with a properly fenced in yard or in a kennel run with proper shelter.  At no time will said dog be chained, or raised on tile floors or floors of equivalent slick texture - recognizing that proper footing is very important to skeletal development.  Purchaser will use extreme caution for the skeletal development of said dog up to one year of age by refraining said dog from horseplay, jumping off high places and rough playing with other dogs.

5.  Purchaser agrees once said dog is bred, Seller is released of the sales contract.  And if bred, Purchaser deems said dog to be of show/breeding quality.

6.  Purchaser agrees to follow supplementation and immunization schedule that is attached.  Purchaser may use another supplementation and immunization schedule recommended by their veterinarian if it is different from the attached schedule.  However, Seller is to be provided with veterinarian’s recommended schedule with written proof thereof.

7.  Purchaser agrees to train or have trained said dog in obedience and/or confirmation.  Purchaser also agrees to socialize said dog among people and other animals.  Purchaser agrees to have said dog crate trained and trained to be comfortable in a kennel run as this will help said dog to adjust to strange situations such as boarding, flying or stressful confirmation showing.  Lack of training and socialization on Purchaser’s part does not constitute poor breeding on Seller’s part.

8.  Carry Seller’s kennel prefix name of “NORTH BAY” on registered name and shall exhibit said dog in match and AKC approved shows under such registered name.  (An ‘s may be added at the end of  NORTH BAY.)

9.  Give Seller 30 day notification of intention to sell said dog and give first right of refusal of repurchasing said dog at original purchase price.  If for some reason Purchaser is not able to keep said dog due to unforeseen circumstances, Seller will do their best to help Purchaser find a new home for said dog.  Seller will not help with finding of a new home if said dog is not crate trained, kennel run trained, has bitten someone, or has a questionable temperament.  If said dog is ever to be returned to Seller, Purchaser is to be responsible for getting said dog back to Seller at Purchaser’s expense.

10.  Purchaser agrees never to sell said dog or any breedings therefrom said dog to pet stores, dog dealers, research laboratories or guard dog businesses.

11.  Notify Seller of serious illness, injury or death of said dog.

12.  Notify Seller if Purchaser moves by providing new address and phone number as this is required knowledge of Seller to maintain good standings with the American Kennel Club (AKC).

13.  Spay or neuter said dog if replacement occurs and provide Seller with written proof from a licensed veterinarian.

14.  Be responsible for all expensed incurred when Purchaser takes possession of said dog.

15.  Purchaser is responsible to keep said dog under control at all times.

                Seller is not responsible for said dog if it has suffered neglect, mistreatment or exhibits temperament faults which are the result of the lack of training or abuse by the Purchaser.  In addition, Seller is not responsible for any damages or bodily harm either directly or indirectly caused by said dog.  There are absolutely no refunds except as stated in Item 1 above under “Seller Agrees To The Following.”

                Seller is not responsible for the reproductively of said dog due to lack of Seller being able to fully control said dog’s full genetic potential or living conditions in which said dog is raised.

                This sales contract is formed and shall be governed by the laws of the State of California and jurisdiction to resolve disputes solely rest  in a court of competent jurisdiction in the State of California in the county of Solano.

It is mutually agreed between  these parties only that all conditions stated above shall extend and be obligatory upon, their heirs, agents, executors and successors of the respective parties and there are no representations respecting said dog or the sale thereof,  except as in this sales contract contained.

 Contract for the Sale of a Pet Quality Akita

This contract is written for the protection of individuals purchasing (Purchaser) and selling (Seller) an Akita, as well as for the protection of the Akita being sold.

The Seller will forward the AKC papers to the Purchaser for each pet quality Akita purchased from North Bay Akitas after the Purchaser has had the male/female Akita neutered/spayed.

Once verification is provided to the Seller that the pet quality Akitas has been neutered/spayed, the Seller agrees to provide AKC papers to the purchaser.
